Dr. Rachel Levmore should be commended for writing in this article that “ The time has come for Stern College to take a stand as “Stern College” – its rabbonim, teachers, administration – clarifying that each and every student of Stern and her chosson sign a prenup.” What Dr. Levmore offers is only a partial solution.

It is pulpit rabbis who are on the “front lines” of this issue as they very often perform weddings are are in a position to influence the couple to sign a Halachik Pre Nup. Pulpit rabbis should refuse to perform weddings unless a Pre Nup is signed. So should Roshei Yeshiva. Having a Halachik Pre Nup should be a universal practice and this is the only way to do it.

Years ago the Gerrer Rebee decreed that there should be limits on the number of people invited to weddings as well as limits on the menu and the size of the band. The Rebee realized people were spending too much on weddings and that the time had come to a stop to it.

After the decree was passed a wealthy Chassid approached the Rebee and explained that while he understood why the Rebee had introduced the new rules, since he was wealthy, the new rules should not apply to him. The Rebee’s answer was simple. “You can follow the rules or find a new Rebee.”

At the fourth annual convention of the International Rabbinic Fellowship that took place this week the following policy was enacted. “ IRF Rabbis may not officiate at a wedding unless the couple has signed a halachic prenuptial agreement. IRF Rabbis are further encouraged to participate ritually only in weddings in which the couple has signed a halachic prenuptial agreement. Ritual participation includes but is not limited to reading the ketubah, serving as a witness, and making one of sheva berachot.”

Rabbis should educate their congregations as to why signing the Pre Nup is required and make it part of the culture of the shul.

Some Rabbis claim they cannot sign it as there are poskim who are opposed to it. This is approach, the need for unanimity before a halachik position can be accepted leads to what what Rabbi Daniel Sperber calls “Paralysis In Halacha.”

The tragedy in the case of Halachik agunot is that there are real human casualties whose lives are literally paralyzed by Rabbinic malpractice.

I had a very similar experience to the one described in this article.

Almost a year ago my father suffered a massive heart attack and eventually underwent a triple bypass. Thank God he is doing well.

During his hospitalization and recovery from surgery, I, along with other family members, spent many days Mount Sinai Hospital in NYC.

Form the outset I was amazed at the work of the Satmar Bikkur Cholim who daily brought kosher food to a well stocked “Kosher Room” in the hospital. This included food for shabbat that was kept warm in a warming box in that special room. The room was not aesthetically pleasing, but it was beautiful in another way, in that it was a meeting place for Jews of all stripes, with one thing in common, a sick loved one. It offered comfort and the knowledge that we were not alone in our worry and concern. It was illness and that magical room that brought me, a Modern Orthodox Rabbi to share Seudah Shlishit with a Satmar Chassid and a Yeshivish women.

When there is common cause or concern, the differences based on details like what kind of kippah one wears or weather or not one is a zionist disappear.

For me it served as a window into what could be if more Jews could be convinced to come together based on common cause rather than separate based on difference.

I know it was just a moment in time, but it is moments like those that create big dreams.

A Kavannah Before Buying A Lottery Ticket:

I will be using the traditional Shabbat Hagadol drasha to speak on the topic of: Jews and Money.

I decided to speak on this topic long before the Mega Millions frenzy started.

I have long been fascinated with the idea that part and parcel of the promise of redemption is great wealth.

Here are the verses from Bereishit

13 And He said unto Abram: ‘Know of a surety that thy seed shall be a stranger in a land that is not theirs, and shall serve them; and they shall afflict them four hundred years; 14 and also that nation, whom they shall serve, will I judge; and afterward shall they come out with great substance.

I can’t help but think of the coincidental relationship between the lottery drawing this week and the “great wealth” that the Jews took with them from Egypt.

Maybe this shabbat is called Shabbat Hagdol the Great Shabbat in anticipation of the “Great Wealth” – “ִּ”רְכֻשׁ גָּדוֹל”that the Jewish people would amass.

The promise of wealth even makes its way into the text of the Haggadah suggesting that in order to properly fulfill the MItzvah of Sippur Yetziat Mitzrayim (retelling the Exodus story) one must discuss this aspect of the events.

Blessed is He who keeps His promise to Israel, blessed be He!For the Holy One, blessed be He, calculated the end [of the bondage], in order to do as He had said to our father Abraham at the “Covenant between the Portions,” as it is said: “And He said to Abraham, `You shall know that your seed will be strangers in a land that is not theirs, and they will enslave them and make them suffer, for four hundred years. But I shall also judge the nation whom they shall serve, and after that they will come out with great wealth.’”

This is an interesting point to discuss at your seder table – why must we talk about the great wealth gained by the Jewish people as part of retelling the story?

A related issue is the use and misuse of wealth.

That same wealth that the Jewish people took with them from Egypt was then used to build the Golden Calf. This represents the profanation of money. (more on this at the Drasha)

The Golden Calf represents the danger of wealth itself being worshipped and viewed as an end in itself. (It can actually get worse. For example, when wealth becomes the determining factor of value in a society – more on this in the Drasha (from Rav Nachman of Breslov) as well)

On the other hand Rabbi Soloveitchik talks about of “Redeeming The Economy”. (See Festivals of Freedom pg. 168 – 172)

In a similar vain, Rabbi Jonathan Sacks defines tzedek as social or distributive justice.

Here are some of his words: “The Judaic vision aims at a society in which there is equal access to dignity and hope. Unlike socialism it believes in the free market, private property and minimal government intervention. Unlike capitalism it believes that the free market, without periodic re-distributions, creates inequalities that are ultimately unsustainable because they deprive some individuals of independence and hope.”

Before buying that ticket ask yourself: How can I make sure that this wealth (hopefully you will win) will be redeemed?

BTW – It’s actually a good question to ask even if you do not buy a ticket.

I have received numerous responses to my previous post on the Mormon conversions of dead Jews. For the most part, they were polite and sincerely interested in dialogue and explaining to my why I was wrong when I wrote: ” “For the Mormons, salvation is simply a matter of Divine Grace. Without any effort, sinners are excused for a lifetime of sins.”

The following is an explanation that is representative of the emails I received. “The Latter-day Saints believe that without Grace, we have nothing. However, it is because of Grace, that we have the opportunity to be forgiven for our sins. However, this forgiveness is only possible “after all we can do”. We believe that “faith without works is dead”.

I was happy to receive the comments and feel fortunate to have the opportunity to dialogue with some Mormons.

I accept this to be the official doctrine of The Church of LDS and I am grateful to those who pointed it out to me.

Being that this is the case, the presence of Hitler on list of those who were or who were to be baptized is puzzling. His presence of the list seems to indicate that a person can live a completely abhorrent life and still be in line for God’s grace after Baptism. If salvation is about works and grace, why put Hitler on the list?

Here is one response that I received to this question. ” It is our belief that people like Hitler have been cast into outer darkness upon their deaths. If there is a bottom to hell, Hitler is there…irregardless of whether or not his name is on a “list”. Again, I ask, if this is so, then why is he on the list.

Some explained the presence of Hitler on the list as well as other dead Jews as the work of rouge Mormons who have been disciplined by the Church. I applaud the Church for their action.

There was one that was was a bit more bold in terms of fate of those of other faiths. “Mormons understand that all will be rewarded according to their works. No kind, good person will ever suffer in the next life, regardless of religious affiliation. All are in Paradise and will go to Heaven. God is just, and good people will not suffer punishment in the next life.”
I wonder, however, if this refers to even the unbaptized?

Finally, I was surprised by two things. I was surprised at how many Mormon’s read this blog….

I was most upset by the fact that the Mormon responders were unable to accept the fact that even without the theological issue I raised, that posthumous baptisms of Jews, many of whom lost their life specifically because they were Jewish, is utterly upsetting to Jews. Some explained that only Jews who were family members of current LDS church members are allowed to be put on the list. I am not sure why this should be considered any less offensive.

In any case, the dialogue has been productive from my standpoint and I have learned a great deal.

One of the most impressive notes was from a Mormon who noted that their personal feeling was the the Church of LDS is not perfect and that there is room for improvement.

I think this is a good approach for all organizations representing organized religion.

Recently the issue of the Mormon church engaging in posthumous conversions has resurfaced. Eh Wall Street Journal reports that:

“Researchers recently discovered that Mormons had similarly baptized the parents of famed Nazi hunter Simon Wiesenthal, whose mother died in a Nazi extermination camp in 1942. And one Mormon recently proposed for proxy baptism the still-living Holocaust survivor and Nobel Laureate Elie Wiesel.” Read More

Naturally Jews are disturbed and insulted by this. No doubt, it has a serious icky factor.

Besides these factors, there is something else, something more religiously important at play here. For the Mormons, salvation is simply a matter of Divine Grace. Without any effort, sinners are excused for a lifetime of sins.

Judaism looks at salvation, or as we call it, forgiveness in an entirely different manner. Rabbi Yitzchak Blau, in an article on Tradition 28:2 explains this approach, popularized by Rabbi Soloveitchik.

Rabbi Blau begins by quoting a Talmudic passage that expresses the difficulty in understanding repentance to begin with.

It was inquired of Wisdom, “What is the punishment of a sinner?” Wisdom said “Evil pursues the wicked.” It was asked of prophecy, “What is the punishment of a sinner?” Prophecy said to them, “The sinful soul shall perish.” It was asked of the Holy One, “What is the punishment of a sinner?”, and He said, ”Let him repent and he will be forgiven.”

The article then goes on to explain the need for human initiative and creativity in the process of repentance.

“Most significantly, Rabbi Soloveitchik employs this theory of repentance as an illustration of the creativity of Halakhic Man. For the Rav, creativity represents an essential characteristic of Halakhic Man:

“The most fervent desire of Halakhic Man is to behold the replenishment of the deficiency of creation, when the real world will conform to the ideal world, and the most exalted and glorious of creations, the ideal Halakha, will be actualized in its midst. The dream of creation is the central idea in the halakhic consciousness the idea of the importance of man as a partner of the Almighty in the act of creation, man as a creator of worlds”

From this perspective, the Rav interprets numerous Jewish texts and explains many mitzvot, including repentance, in a new light. Here, the Schelerian view of repentance is crucial. If one views atonement as the miraculous intervention of God against all logic, then man plays at best a passive role in the process. Repentance would certainly not be so significant a component of man’s religious personality. However, the Schelerian understanding of repentance shifts the focus from God’s activity to that of man. Repentance exhibits man at his most creative, as he remolds and refashions his own personality. Rav Soloveitchik points to the halakha that repentance is manifested by changing one’s name. Through repentance, man recreates himself and truly deserves to be referred to by a different name.

It should be noted that Scheler’s approach does not necessitate that man attains forgiveness independently, that is, without any Divine assistance. What his analysis accomplishes is to show how regret and remorse function creatively and positively. Though man may call upon Divine benevolence to achieve atonement, he acts on his own in order to deserve that bestowal of kindness.” Read more

Like the rest of Jewish life, Rachmana Liba Ba’ei – God desires the heart and real religious experience is not defined by the fulfillment of certain rituals or recitation of words. Authentic spirituality is located in the heart and defined by noticeable change in our behaviour.

OK. So after writing and posting this serious post, I was sent a link with Stephen Colbert’s take on the Mormom conversions.

It was suggested that I put the entire letter I wrote about responding to Beit Shemesh on the blog – so here it is.

Dear Friends,

A few weeks ago I spoke in shul about the ongoing crisis in Beit Shemesh, Israel where a group of extremist Chareidim are attempting to intimidate the Religious Zionist / Modern Orthodox community. There has been rock throwing, spitting, verbal abuse and threats.

After the sermon a number of people asked if there is anything that our community can do to support the community under attack.

In response to those inquiries I contacted leaders of the MO/RZ community in BeitShemesh. After much discussion a conclusion was reached that the best response on our part would be to assist the MO/RZ community in strengthening their presence in Beit Shemesh by raising funds so that their youth group headquarters can be completed. I cannot think of a better way to counter the intimidation that is meant to drive this community away than to build and put down even stronger roots.

This response on our part creates a Kiddush Hashem (sanctification of God’s name) by reacting in a positive manner and in a way that will directly affect the children who have been the targets of the intimidation. The headquarters will be on the campus of the local Religious Zionist elementary schools – Orot Banot and Orot Banim, the very schools that have been targeted by the extremists. The vast majority of members of the youth group attend the Orot schools.

Checks can be made out to American Friends of Beit Knesset Feigenson” a US 501(c)(3) charitable organization. Please note on the check that the funds are for the “Ezra snif” and mail to: Marc Tobin , Rechov Hayasmin 21 A, Beit Shemesh, Israel 99591.

“But the more they were oppressed, the more they increased and spread out…” (Exodus 1:12)

This project presents us with an opportunity to reply to intimidation with courage, to react to destruction with building, ands most importantly, to answer Chillul Hashem (desecration of God’s name) with Kiddush Hashem (sanctification of God’s name).

With hopes for peace and with love of Zion,

Rabbi Barry Gelman

There have been numerous takes on the recent events in Beit Shemesh. Most of them have focused on politics and sociology. I would like to offer a brief analysis based on spiritual values and, humbly submit what we can learn from our reaction to these events.

The chareidi men who have been harassing the little girls and the mothers claim to be acting L’Shem Shamayim, for the sake of Heaven, and in the name of God.

Rabbi Abraham Isaac Kook, who was no stranger to controversy or, for that matter, people saying horrible things about him and doing despicable things to him wrote the following about the limits of what we do for the sake of heaven.

כבוד-שמים המושג השגה בהירה מרומם הוא את ערך האדם וערך כל היצורים כבוד שמים מגושם הוא נוטה לע”ז, ומשפיל את כבוד האדם וכבוד כל הבריות

“When the duty of honor God is conceived of in an enlightened manner, it raise human worth and thew worth of all creatures…But a crude conception of God tends toward the idolatrous and degrades the dignity of humanity… “

Rav Kook is reminding us that honor of God that is based on the greatness of human beings, created in the image of God uplifts people. On the other hand, honor of God understood in a shallow fashion, as if God needs our honor, leads to anger toward those who do not honor God, and is idolatrous as, by definition, a wrong conception of God is being honored. This incorrect undersntanding of God leads to people being degraded and mistreated, all in the name of God. Rav Kook goes on with something even more amazing:

ע”כ גדול הוא כבוך הבריות שדוחה את לא-תעשה שבתורה , להורות על כבוד שמים הבהיר, המגדל בטובו את יסוד כבוד הבריות

It is for this reason the sages declared that the dignity of persons is so important that is supersedes a negative precept of the Torah…”

Here Rav Kook reminds us that performance of MItzvot can actually get in the way of Kavod Shamayim. Thus, in some cases, even God’s honor, in terms of some commandments, is set aside in order to protect the honor of a human being. What we have here is a real definition of what it means to honor God. In Rav Kook’s mind, it is simple. If something brings honor to another human being, it can be considered honor of God as well. On the other hand, if something brings disparagement or harassment to another human being, then by definition, it cannot be an honor to God. Rav Kook’s teaches that in all of our endeavours, even in our striving to to Mitzvot, that how we do what we do goes to the very legitimacy of our act. Perhaps not always, but in many many cases, the litmus test of deciding if what I am doing is a mitzvah or not is easy: Does it being honor to others?

It is clear that the Chareidi protestors in Beit Shemesh have lost all sense of what it really means to act L’Shem Shamayim. Spitting on little girl and calling women prostitutes does not fit Rav Kooks definition.

While what is going on in Beit Shemesh is horrible, it does offer us the opportunity for some introspection. What is so troubling is that these people are using any means neccesary to achieve their goals, even if means harming and disparaging others. The upset this is causing us should remind us to be careful in terms of what means we use to achieve our goals. Even in our religious strivings, we must be mindful of how our actions affect others. Is there a way to achieve our goal without hurting others? If not, is it really a worthwhile goal? Have we exhausted all of our halachik creativity to reach our goal while at the same time, protecting the dignity of others.

It is easy to engage in Chareidi bashing, but it will much more productive if we use our understandable indignation as a catalyst to self improvement.

1. This article expresses a position I have taken in my work with Christian Zionists. My work with Christian Zionists has been extraordinarily rewarding and fulfilling. However, I draw the line and will not work with Messianic jewish groups who claim that one can be Jewish and accept Jesus as one’s Lord and Savior. Being Jewish and accepting Jesus are mutually exclusive and many of these groups prey on unaffiliated Jews and lure them in. You can find the original article here.

2. A wonderful article by Noam Zion: The Rabbinic Idea of Peacemaker: David Hartman Reads Maimonides’ Laws of Chanukah
